Welcome to Barefoot Osteo Warrnambool! FUNGI FUNGI PTY LTD (ABN 26 662 203 616), trading as Barefoot Osteo.
These Terms & Conditions explain how we run the clinic, how appointments and fees work, and what you can reasonably expect from us.
By booking or attending an appointment, or using our website or online booking system, you agree to these Terms & Conditions.

1. Payment Terms
1.1 Payment at Time of Service
- All consultation fees are payable at the time of your appointment, unless we have agreed otherwise in writing (for example, with an insurer or third party).
- If a third party does not cover part or all of the consultation fee, you are responsible for the outstanding balance.
1.2 Accepted payment methods
- We currently accept:
- EFTPOS / debit card
- Credit card
- Cash
- We may update our accepted payment methods from time to time.
1.3 Outstanding accounts
- If an amount remains unpaid after your appointment (including any late cancellation or non-attendance fees), we may:
- Send an invoice by email or SMS; and
- Request that the outstanding balance is paid before future appointments are booked or confirmed.
2. CANCELLATION, RESCHEDULING & NON-ATTENDANCE
Your appointment time is reserved just for you. Late cancellations and missed appointments are difficult to fill and impact other people waiting for care.
2.1 Minimum notice period
- We require a minimum of 24 hours’ notice if you need to cancel or reschedule your appointment.
- If you provide 24 hours’ notice or more, there is no cancellation fee, and we genuinely appreciate the notice as it allows us to offer that time to someone on the waitlist.
2.2 Late cancellations and missed appointments (<24 hours)
- If you:
- Cancel,
- Reschedule, or
- Do not attend your appointment
with less than 24 hours’ notice, and we are unable to fill the appointment time, a late cancellation fee equal to the full consultation fee (currently $99) will be charged.
- This fee reflects:
- The clinical time reserved for you, and
- The reduced ability to offer that time to another person.
2.3 Sudden illness and emergencies (late notice only)
- We understand that sudden illness and genuine emergencies can occur.
- Where a cancellation or non-attendance occurs with less than 24 hours’ notice due to unexpected illness or emergency, the osteopath may, at their discretion, waive or reduce the late cancellation fee.
- In these situations (and only where notice is less than 24 hours), we will request a medical certificate or similar documentation if you would like us to consider waiving or reducing the fee.
2.4 Outstanding cancellation fees and future bookings
- Any outstanding late cancellation or non-attendance fees must be paid before further appointments can be scheduled or confirmed, unless otherwise agreed in writing.
- We may offer to take payment over the phone or via secure electronic invoice prior to your next appointment.
2.5 Late arrivals
- If you arrive late, your session may need to be shortened to finish on time and avoid impacting the next client.
- In some cases, if you are significantly late, your appointment may need to be rescheduled and may still be treated as a late cancellation (see Section 2.2).
2.6 Rescheduling by The Barefoot Osteo
- If we need to cancel or reschedule your appointment due to illness, emergencies, or unavoidable circumstances, we will notify you as soon as reasonably practicable and work with you to find an alternative suitable time.
- No cancellation fee is charged where the clinic initiates the change.
3. ONLINE BOOKINGS, REMINDERS & COMMUNICATIONS
3.1 Online booking systems
- We use third-party platforms (such as Cliniko) for online bookings and appointment reminders.
- By booking through these platforms, you also agree to their terms and privacy policies.
3.2 Booking confirmations and reminders
- We may send you booking confirmations and reminders by SMS and/or email.
- These are provided as a courtesy only. It is still your responsibility to:
- Know your appointment time, and
- Contact us if you need to change or cancel your booking in line with Section 2.
3.3 Technical issues
- The Barefoot Osteo is not responsible for technical faults with third-party systems (for example, emails going to spam, undelivered SMS messages, or booking system outages).
- If you are unsure about an appointment time, please contact us directly.
4. CLINICAL CARE, SCOPE & LIMITATIONS
4.1 Nature of osteopathic care
- Osteopathic treatment involves hands-on techniques, movement assessment, and, where appropriate, exercise or lifestyle advice.
- We will always aim to explain:
- The proposed treatment plan,
- Any risks or likely discomfort, and
- Alternatives you may wish to consider.
4.2 No guarantee of outcome
- While we take care to provide high-quality, evidence-informed care, we cannot guarantee specific outcomes or results.
- Every person’s situation is different and responses to treatment vary.
4.3 Your role in treatment
- Your progress may depend on:
- Attendance at recommended appointments,
- Following advice regarding exercises, activity, and recovery, and
- Informing us of any changes in symptoms or health status.
4.4 Emergencies and urgent care
- The Barefoot Osteo is not an emergency service.
- If you have a medical emergency or serious new symptoms (for example, chest pain, difficulty breathing, sudden neurological symptoms), you should contact 000 or attend the nearest emergency department or urgent care clinic.
5. EXERCISE, SELF-MANAGEMENT & HOME CARE ADVICE
5.1 Exercise and activity programs
- You may be given specific exercises, stretches, or movement strategies to perform between appointments.
- These are tailored to you at the time they are prescribed, based on information available to us.
5.2 Your responsibility
- You are responsible for:
- Performing exercises as instructed,
- Stopping if you experience significant pain, dizziness, shortness of breath, or other concerning symptoms, and
- Informing us promptly if any exercise or activity causes unexpected or severe discomfort.
6. WEBSITE, CONTENT & INTELLECTUAL PROPERTY
6.1 Ownership of content
- Unless stated otherwise, all content on our website, printed materials, and social channels (including text, branding, logos, graphics, and resources) is the intellectual property of The Barefoot Osteo.
6.2 Personal use only
- You may view and download materials for your personal, non-commercial use.
- Reproducing, editing, or distributing our content for commercial purposes without prior written consent is not permitted.
7. LIMITATION OF LIABILITY
7.1 General
- To the fullest extent permitted by law, The Barefoot Osteo is not liable for any indirect, incidental, or consequential loss arising from the use of our services or website.
- Nothing in these Terms & Conditions is intended to exclude or limit any rights you have under the Australian Consumer Law (see Section 8).
8. AUSTRALIAN CONSUMER LAW
8.1 Consumer guarantees
- Our services come with guarantees that cannot be excluded under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL).
- You may be entitled to a remedy where a service:
- Is not provided with acceptable care and skill,
- Is not fit for a particular purpose you made known to us, or
- Is not provided within a reasonable time.
8.2 No limitation of mandatory rights
- Nothing in these Terms & Conditions is intended to exclude, restrict or modify any of your non-excludable rights under the ACL or other applicable laws.
9. CLIENT RESPONSIBILITIES
By booking and attending appointments with The Barefoot Osteo, you agree to:
- Provide accurate, complete and up-to-date information about your health, medications, and relevant history.
- Inform us of any changes in your health or new diagnoses as soon as practicable.
- Follow reasonable instructions regarding pre- and post-treatment care, within your own comfort and capacity.
- Adhere to the cancellation and rescheduling policy outlined in Section 2.
10. PRIVACY & HEALTH INFORMATION
- We collect, store, and use personal and health information in line with:
- Applicable Australian and Victorian privacy and health records laws, and
- Our Privacy Policy, which sets out more detail about how your information is handled.
- Our current Privacy Policy is available on our website or by request from the clinic.
11. COMPLAINTS & FEEDBACK
We welcome feedback and take concerns seriously.
- If you have a concern about your care, fees, or any aspect of our service, we encourage you to contact us first at:

- We will aim to respond and, where possible, resolve the issue promptly.
If you feel your concern has not been resolved, you may raise it with the relevant external body, such as:
- Ahpra – for concerns about registered health practitioners, and/or
- The Health Complaints Commissioner (HCC) Victoria – for concerns about health services more generally.

12. CHANGES TO THESE TERMS
- We may update these Terms & Conditions from time to time, for example to reflect changes in law, clinical practice, or clinic operations.
- The current version will always be available on our website or by request.
- Continued use of our services after an update takes effect will be taken as your acceptance of the updated terms.
13. GOVERNING LAW
These Terms & Conditions are governed by the laws of the State of Victoria and the Commonwealth of Australia. Any disputes will be subject to the jurisdiction of the courts of Victoria.
Q: What happens if I need to cancel my appointment?
If you cancel with at least 24 hours’ notice, no fees apply. Less than 24 hours’ notice or a no-show will result in a $99 cancellation fee & a medical certificate may be requested.
Q: What if I’m running late?
If you are more than 7 minutes late, you may proceed with the remaining time of your appointment or cancel and incur the $99 cancellation fee.
Q: Can I reschedule my appointment?
Yes, appointments can be rescheduled with at least 24 hours’ notice without incurring any fees.
Q: How is my personal information handled?
Your information is managed in accordance with our Privacy Policy, which ensures your data is protected and used solely for the purposes of your care.
Q: What payment methods do you accept?
We accept EFTPOS, credit cards, and HICAPS for health insurance claims. Payments are due at the time of service.
Q: Can I opt out of marketing communications?
Yes, you can opt out of emails or SMS messages by contacting us directly.
